The following are the Terms and Conditions (the "Agreement") that govern your access to and use of our online therapy platform (collectively the "Platform"). Uncursed LLC owns and operates this website, 19644 Clubhouse Road Gaithersburg Village, MD, USA. The Platform may be provided or made available through a variety of websites or applications, whether owned and/or operated by us or by third parties, including, but not limited to, the website uncursed.com and its related apps.
You agree to this Agreement by accessing or using the Platform. Before using the Platform, you should carefully read this Agreement. You must not use the Platform if you do not agree to be bound by any of the terms of this Agreement. In this Agreement, the terms "we," "us," "our," and similar expressions refer to any company that owns and operates the Platform (the "Company").
Privacy and Security
We place a high priority on preserving and protecting any information you share with us through the Platform. Our Privacy Policy, which is accessible at https://about.uncursed.com/privacy-policy, contains information about our security and privacy practices. "Privacy Code").
YOU AGREE TO THE RULES OF THE PRIVACY POLICY BY AGREEING TO THIS AGREEMENT AND/OR USING THE PLATFORM. THIS AGREEMENT INCLUDES THE PRIVACY POLICY AND IS DEEMED TO INCLUDE IT. THE PRIVACY POLICY IS SUBJECT TO THE SAME RULES THAT APPLY TO MODIFICATIONS AND REVISIONS OF THIS AGREEMENT.
Christian Spiritual Care Providers, Coaching and Mentorship Services
The uCare Platform may be used to connect you with a Spiritual Care provider who will provide services to you through the Platform ("Spiritual Care Services"). Spiritual Care Providers are independent service providers, not our employees, agents, or representatives. The Platform's role is limited to making Spiritual Care Services available. Spiritual Care Providers are solely responsible for the delivery of Spiritual counseling, coaching, and mentoring Services. If you believe the Spiritual care Services provided by the Spiritual Care Provider do not meet your needs or expectations, you may switch to another Spiritual Care Provider who offers services through the Platform.
If the Spiritual Care Provider discontinues providing services through UCare, we will send you an email informing you that your Spiritual Care Provider is no longer on the Platform and that you have the option to match with a new Spiritual Care Provider.
In spite of the fact that some of our Spiritual Care Providers are licensed in their respective professional fields, they provide 100% Christian Spiritual Care, Spiritual Counseling, Coaching, Pastoral and Mentoring Services that integrate biblical principles with other professional approaches. While we hope that their Spiritual Care Services are beneficial to you, you understand, agree, and acknowledge that they may not be the best solution for everyone's needs, that they may not be appropriate for every situation, and that they are not a full substitute for a face-to-face medical examination and/or care in every situation.
IF YOU ARE CONSIDERING SUICIDE, HARMING YOURSELF OR OTHERS, OR FEELING THAT ANY OTHER PERSON MAY BE IN DANGER, OR IF YOU HAVE A MEDICAL EMERGENCY, YOU MUST CALL YOUR LOCAL EMERGENCY SERVICES NUMBER AND NOTIFY THE RELEVANT AUTHORITIES IMMEDIATELY. THE PLATFORM IS NOT INTENDED FOR USE IN ANY OF THE ABOVE CASES, AND THE SPIRITUAL CARE PROVIDERS ARE UNABLE TO PROVIDE THE ASSISTANCE REQUIRED IN ANY OF THE ABOVE CASES.
THE PLATFORM IS NOT INTENDED FOR CLINICAL DIAGNOSIS REQUIRING AN IN-PERSON EVALUATION, AND YOU SHOULD NOT USE IT IF YOU REQUIRE ANY OFFICIAL DOCUMENTATION OR APPROVALS FOR PURPOSES SUCH AS, BUT NOT LIMITED TO, COURT-ORDERED THERAPY OR EMOTIONAL SERVICE DOG CERTIFICATION.
Third-Party Content
The Platform may contain other content, products or services which are offered or provided by third parties ("Third Party Content"), links to Third Party Content (including but not limited to links to other websites) or advertisements which are related to Third Party Content. We have no responsibility for the creation of any such Third Party Content, including (but not limited to) any related products, practices, terms or policies, and we will not be liable for any damage or loss caused by any Third Party Content.
Payments, Commissions, and Payout
Providers are responsible for setting hourly rates. We offer in-platform wallet payments, allowing clients to make payments directly for services offered via the wallet in-platform. Our Commission: Our fees are calculated as a percentage of your earnings. Ucare applies a 20% commission fee based on your per-hour billing per client. Funds are deposited by bank transfer weekly.
Disclaimer of Warranty and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY NATURE RESULTING FROM THE THERAPIST SERVICES OR THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE OF ANY SPIRITUAL CARE SERVICES AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM.
YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, NON-INFRINGEMENT, SECURITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY. THE USE OF THE PLATFORM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES.
YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT OUR AGGREGATE LIABILITY FOR DAMAGES ARISING WITH RESPECT TO THIS AGREEMENT AND ANY AND ALL USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU OR ON YOUR BEHALF THROUGH THE PLATFORM IN THE 12 MONTHS PERIOD PRIOR TO THE DATE OF THE CLAIM.
